Our firm has served as lead counsel or co-counsel in several derivative actions. In Trumbo et al. v. The Inland Group, et al. (Circuit Court of Cook County, IL No. 13-CH-07790), we prosecuted claims for breach of fiduciary duty on behalf of stockholders in InvenTrust Properties Corp. (f/k/a Inland American Real Estate Trust, Inc.), achieving a settlement of $11.1 million.

In Lang et al. v. Last Atlantis Capital Management LLC et al. (Circuit Court of Cook County, IL No. 08-CH-46044), we represented members of an investment company in a derivative lawsuit against its managing member, introducing broker, and clearing broker. We subsequently became lead counsel for the court-appointed receiver of the investment company. We achieved a substantial recovery for the receivership estate and successfully defended against the clearing broker's claims.

Our experience in complex commodity futures litigation includes our representation of a commodity pool in the MF Global, Inc. bankruptcy proceeding (In Re MF Global, Inc., U.S. Bankruptcy Court S.D.N.Y. No. 11-2790). We prosecuted a claim for wrongful liquidation in violation of the Commodity Exchange Act and obtained court approval of the claim in the amount of $2.1 million which made our client one of the largest non-affiliate general creditors.

We have represented many investors in the arbitration forums of the Financial Industry Regulatory Authority (FINRA), the National Futures Association (NFA) and the Chicago Mercantile Exchange (CME), and in the reparations forum of the Commodity Futures Trading Commission (CFTC) in cases involving fraud, misrepresentations and ommissions, breach of fiduciary duty, violations of state and federal securities laws, violations of the Commodity Exchange Act, control person liability, unsuitable recommendations, failure to supervise, churning, and negligence.

Our firm also frequently represents financial industry members in commercial and employment disputes and in regulatory and compliance matters. We have defended many clients in proceedings before various state and federal agencies including the CFTC.
